High Court no to ownership right to allottees

Chandigarh, August 17

Taking note of allegations that plots for the homeless and the landless were allotted to the relatives of a sarpanch, the Punjab and Haryana High Court today directed that the allotments would not confer ownership right on the allottees.

The directions by the Bench of Justice Rajan Gupta and Justice Karamjit Singh came on a petition filed against the state of Punjab and other respondents by Raman Preet Singh Bara through counsel Munish Gupta.

Gupta contended the Gram Panchayat of Bara village in Gurdaspur district allotted five-marla plots to "the homeless and the landless" by way of a resolution dated November 22 last year. A substantial number of them were Scheduled Castes. He added that most of the allottees were the relatives of the Sarpanch's family.

"The entire exercise was undertaken during the period of lockdown. According to him, in the absence of vide publication and due procedure, such allotment is vitiated," Justice Gupta observed, while issuing notice of motion to the state and other respondents for November 5. — TNS
