HC stays orders summoning ex-IAS officer, two others

The Punjab and Haryana High Court today stayed Panchkula CBI Court orders summoning former IAS officer DR Dhingra and two others in the Manesar land case trial.

Taking up the petitions filed by Dhingra, Dhare Singh and Surjit Singh, Justice Arvind Singh Sangwan fixed the case for April 30 before asserting: "In the meantime, the operation and implementation of the impugned order dated December 1, 2020, shall remain stayed qua the petitioner(s)".

The petitioners were represented by senior advocates RS Rai and Vinod Ghai, along with counsel Gautam Dutt, PS Ahluwalia and Deepender Singh. The CBI was represented by Sumeet Goel.

The High Court has already stayed the order summoning Haryana Additional Chief Secretary (Home-cum-Health) Rajeev Arora in the case. The special Court had summoned Arora to face trial and appear on December 17, last year.

It was contended that the trial court order was completely without jurisdiction and ex-facie illegal. The trial court completely erred in resorting to the provisions of Section 193 of the CrPC, which power was no longer available, since the matter was listed for the consideration/arguments of charge. The provision deals cognisance of offences, by the Courts of Session.
